We have a student house where the joint tenants have fallen out over the utility bills. The tenancy is drawing to an end and it is time to return the deposit which is lodged with the DPS. The lead tenant is adamant that one of the other tenants owes a substantial sum in unpaid bills and is not willing to release her share of the deposit. Where do I stand in this situation? Can I withhold the deposit until the matter is settled? If she continues to refuse to release the other tenant's share - what do I do next?
