Bit of a strange one this one:
I have a tenant who told me they are moving abroad on 3rd January 2010. He emailed me agreeing to meet on 29th December to hand over keys and settle outstanding rent, (final month as he was one month behind).
Tenant was not at the property on 29th all day and into the evening, (yes i waited). Spoke to neighbour and she told me that she only saw him about once every 3 months or so. Checked with council tax and they confirmed that property is now registered for council tax in my name as of 3rd Jan.
I suspect he has moved abroad as he has a wife who is from the Philippines. The house still has limited possessions in it from what I can see. Bit concerned about lack of heating and cold weather, also insurance risk if the property is unoccupied.
I understand the risks of illegal eviction but looking from a practical point of view, i suspect he doesn't want to pay last months rent so didnt meet me. If I change the locks and stick an abandonment notice on the door with my number on and just give him the new key without a fuss if he turns up, am I liable for any prosecution?
