When it comes to Section 8, Section 21 and N5B forms, many of our members call in for advice on how to complete them in a manner that they will not be rejected by the court, some would simply prefer it if someone else could complete the forms for them.

The RLA Possession Paperwork Service, available for members only, is designed to provide you with the confidence that your paperwork is completed correctly before you serve or submit it.

Our Landlord Advice Team will request all related documents to support the completion of the requested form. Once we have all these necessary documents, we will check you can serve it validly, and return a completed form for you to sign within 5 days.

Section 8 notice

Also known as a 'section 8 possession notice', it can only be issued to a tenant who has breached the terms laid out in the tenancy agreement and if certain conditions have been met, the most common being one involving rent arrears. The Housing Act 1988 provides 17 grounds on which a landlord may seek possession before the fixed term of tenancy has finished.

To complete a Section 8 notice for you we need your:

  • Assured Shorthold Tenancy
  • Rent Statement
  • Deposit Certification (if a deposit was taken)

Section 21 notice

This is the no fault way of obtaining possession of the property i.e. the landlord wants to regain possession of a property at the end of an Assured Shorthold Tenancy (AST) or wishes to exercise a "Break Clause". The landlord is able to issue the tenant with a Section 21 notice without giving any reason for ending the tenancy agreement.

To complete a Section 21 notice for you we need your:

  • Assured Shorthold Tenancy
  • Deposit Certification (if a deposit was taken)

Accelerated Possession - N5B Court Form

Once a Section 21 notice has expired, it is possible to apply for possession without needing to appear in court. This is called accelerated possession and the N5B form is the application to court to start this process. It is available to landlords using the section 21 notice provided they were the original landlord and they have a copy of the first and latest tenancy agreement.

To complete an N5B Court Form for you we need your:

  • Assured Shorthold Tenancy (original and current Assured Shorthold Tenancy)
  • Section 21 Notice
  • Deposit Certification (if a deposit was taken)
  • HMO Licence copy (if relevant)
